Privacy Policy

This policy explains how ExamRecalls AI ("we", "us") handles personal information. It is written to align with the Australian Privacy Act 1988 and the Australian Privacy Principles (APPs), including the 2024–2026 reforms.
1. Who we are
ExamRecalls AI is an online study tool operated from Australia. Our designated privacy contact is privacy@examrecalls.fun. Postal enquiries can be arranged via the same address.
2. What we collect
- Account information — email, display name, branch (dentistry / medicine / nursing / student), country, target exam or field of study, optional accent region.
- Audio recordings and uploads you capture in the app (lectures and short "quick note" voice memos).
- Transcripts generated from your audio, and any tidied or corrected versions.
- AI-generated study content derived from your transcripts (notes, summaries, MCQs, OSCE scenarios, study plans).
- Usage metadata — counts of recordings and quick notes, minutes transcribed, streak activity, plan and billing status.
- Payment data — handled by Stripe. We only receive the last-four digits, card brand, subscription status, and Stripe customer / subscription IDs. We never see or store full card numbers.
- Opt-in only: if you enable "Share anonymised corrections", we store the original transcript phrase and your correction, without your user ID.
3. Why we collect it
- To operate the service — record, transcribe and store your study material.
- To generate study content tailored to your target exam.
- To measure your weekly usage against your plan's fair-use quota.
- To operate billing and send account-related, non-marketing emails.
- To provide customer support and to improve transcription accuracy (only from opt-in anonymised corrections).
4. Automated decision-making and AI processing
Consistent with the Australian Privacy Act reforms taking effect on 10 December 2026, we disclose the following:
- How AI is used. We use automated systems (large-language and speech-to-text models) to transcribe your audio and generate study content — notes, summaries, high-yield points, mnemonics, MCQs, OSCE scenarios and study plans — from your transcripts and profile.
- Kinds of personal information used. Audio recordings, transcripts, and your selected branch / country / target exam. For study plans we also use your exam date and recent lecture titles. We do not send your email, payment details or account identifiers to the AI providers.
- Nature of outputs. Outputs are AI-generated and are marked as such in the product. They are study aids only, not medical, dental, nursing or legal advice. Verify all content against your official curriculum before relying on it.
- No solely-automated decisions about you. We do not use AI to make legal or similarly significant decisions about individuals.
5. Overseas disclosure (APP 8)
Some processing takes place outside Australia. Where personal information is disclosed to overseas recipients, we take reasonable steps to ensure they handle it consistently with the APPs.
- Speech-to-text (audio & transcripts) — Deepgram, USA: deepgram.com/privacy.
- AI model provider (transcripts, profile fields) — via the Lovable AI Gateway, routed to model providers primarily in the USA: lovable.dev/privacy.
- Payments (billing data) — Stripe, USA / Ireland: stripe.com/privacy.
- Database, storage and authentication hosting — Supabase / AWS: supabase.com/privacy.
6. Consent and choice
- Anonymised transcription corrections — off by default, opt-in, revocable any time from Settings or Data Controls.
- Inactivity email reminders — on by default; toggle off in Settings or Data Controls at any time.
7. Data retention
- Account info — kept while your account is active.
- Audio recordings — kept until you delete the lecture or your account. Deletion removes the audio file within 24 hours.
- Transcripts & generated notes — kept until you delete the associated lecture or your account.
- Correction events (opt-in only) — retained without user ID, indefinitely, unless you ask us to remove them.
- Payment records — retained by Stripe for the period required by financial law (typically 7 years).
- Account deletion — deleting your account from Settings → Danger zone triggers full removal of your data within 30 days.
8. Your rights
- Access — download a machine-readable copy of everything we hold about you from Data Controls → Export my data.
- Correction — update your profile fields at any time in Settings.
- Deletion — delete individual lectures from Library, or permanently delete your account from Settings → Danger zone.
- Withdrawing consent — toggle correction sharing or notifications off at any time.
To exercise a right that isn't self-service, email privacy@examrecalls.fun. We aim to respond within 30 days.
9. Data breaches (Notifiable Data Breaches scheme)
We maintain a breach response process consistent with the Notifiable Data Breaches scheme under Part IIIC of the Privacy Act. Suspected eligible data breaches are assessed promptly, and we notify the Office of the Australian Information Commissioner (OAIC) and affected individuals where the scheme requires it.
10. Complaints
Send complaints to privacy@examrecalls.fun. We will acknowledge within 7 days and aim to resolve within 30 days. If you are not satisfied, you can lodge a complaint with the OAIC at oaic.gov.au.
11. Children
The service is intended for users aged 16 and over. We do not knowingly collect personal information from anyone under 16. If you believe a minor has created an account, email privacy@examrecalls.fun and we will remove it.
12. Marketing emails
Any marketing or promotional emails we send comply with the Australian Spam Act 2003: they are consent-based, identify us as sender, and include a working unsubscribe link. Account and billing emails are transactional and are not covered by that unsubscribe.
13. Changes to this policy
We update this policy when practices change. Material changes are notified by email to your account address at least 14 days before they take effect. The "Last updated" date at the top always reflects the current version.
